OSU sued for truck accident that took freshman's leg

Ohio State University is being sued by the family of a student after a September truck accident on campus that left him with serious injuries.

The young man was riding his bike to class when he was struck by a dump truck, which was on campus for work on a new engineering building. The cyclist lost his right leg and had severe pelvis and spine injuries. In addition, he was also plagued by serious infections that could have been deadly.

The facts do not appear to be at issue in this case. No one has argued that the dump truck hit the student while he was riding his bike near a construction zone entrance. What is being disputed is how these facts should be interpreted to determine who was at fault for the accident.

His family has sued OSU and the driver of the truck, as well as ten contractors hired by OSU who were allegedly involved in the construction near the crash site. The man's family believes that the crash was foreseeable and that OSU did nothing to prevent it.

The construction zone created a hazardous, high-traffic area and the university failed to provide flaggers, security officials or other safeguards, the suit against OSU alleges.

The accident occurred about the same time that OSU was creating and implementing a traffic safety task force. This was prompted by a series of accidents involving pedestrians, cyclists and motorists on campus, pointing to a widespread problem.
