Cleveland Indians settle lawsuit over fallen slide fatality

The Cleveland Indians last month agreed to settle a wrongful death lawsuit stemming from a collapsed inflatable slide. The slide had fallen on a man outside Progressive Field, causing serious injuries that eventually led to his death.

The victim attended a Cleveland Indians game in the summer of 2010 while the team was hosting a "Kids Fun Day." The event included an inflatable slide, which fell on top of the man. It broke three bones in his back. Nine days later he died from a pulmonary embolism brought on by the fractures and related inactivity.

His widow brought a wrongful death lawsuit against the Indians, the company that set up the slide and several other entities. The company that owned and set up the slide failed to appear in court and was recently ordered to pay the widow $3.5 million. According to the lawsuit, they claimed to properly secure the slide, which caused it to topple over under the weight of the children using it.

The Indians agreed to settle because, according to their attorney, trials are unpredictable. He added that the team recognized the widow's great loss and felt it was appropriate to resolve the case quickly.
